    The Catholic Church in Poland in the Years 1944-1950

    The reality, in which the People’s Republic of Poland found itself after world war II, made the Catholic Church in Poland meet the new challenges, in spite of much authority which it had in the society. The one of a principle importance was breaking the Concordat by the State authorities. After a certain period of time lack of any legal solution on such a level considerably complicated relations between the State and the Church. Searching closure in this area was supposed to guarantee the Church certain freedom in priests’ activities and the State authorities – acceptance in the international arena. In spite of certain inconveniences the Polish Episcopate decided to sign an agreement, which however did not protect the Church against further excluding from the social life.

    Udeľovanie absolutória členom štatutárnych orgánov obchodných spoločností

    The liability of members of the Board, as a legal institute, has a separate place in general liability. It has a specific nature, which is the possibility to give the absolutorium of liability. The expression „absolutorium“ does not have a legal definition. However we can explain this expression as a complete or partial exemption from liability. Absolutorium is associated with the professional care, which result from law, for the members of the Board. At present we can see many cases, in which absolutorium is awarded to the members of the Board. Therefore it is important to know the legal conditios for awarding it.

    The presented paper makes a juridical and scientific analysis of the status and duties of the Head Municipality Supervisor in the whole structure of municipality and its internal inspection system. The article aims at analyzing the deficiencies in the legal regulations being in force, which determine the activity of the department of internal control and inspection in municipalities, as well as improvement of the municipality internal inspection system, which could be brought by the newly approved legislation change at the level of de lege ferenda. The presented scientific contribution focuses on the institution and office of the Head Municipality Supervisor. The task of the paper is to discover actual, real and expected in the future state and the ways to improve the legislation determining the status of the Head Municipality Supervisor in the municipality system of internal control and inspection through clarification of the present legislative standards.

    Przywileje spadkowe w rozwoju historycznym rzymskiego prawa prywatnego

    W grupie przywilejów spadkowych za najstarsze uważane jest beneficium abstinendi, które znane było prawdopodobnie w I w. p.n.e. i powszechnie stosowane przez cały okres klasyczny, aż do Justyniana. Drugim w kolejności dobrodziejstwem było bonorum possessio. Następnym przywilejem było beneficium legis Falcidiae, wprowadzone na podstawie Lex Falcidia z 40 r. p.n.e. Kolejnym beneficjum było beneficium separationis bonorum, które na przełomie II i III wieku było już wykształcone i powszechnie stosowane, a następnie umieszczone w kodyfikacji justyniańskiej. Dalszym przywilejem było privilegium militum, które dotyczyło od Julisza Cezara sporządzania testamentu żołnierskiego (testamentum militis), a za Justyniana stało się szczególną formą testamentu. Do tego privilegium zaliczane było od Augusta peculium castrense czyli specjalny majątek syna rodziny nabyty w związku ze służbą wojskową. Powstałym najpóźniej (531 rok) przywilejem było beneficium inventarii. Jednakże w praktyce zastąpiło ono niektóre wcześniejsze rozwiązania prawne, tj. beneficium abstinendi, legis Falcidiae oraz separationis bonorum jako mniej korzystne. Z rozwiązania tego korzystają także współczesne ustawodawstwa (np. art. 1012 polskiego kodeksu cywilnego oraz art. 7774 francuskiego c.c.; § 1993 BGB; art. 800 ABGB; art. 470 włoskiego c.c. oraz art. 1030 hiszpańskiego c.c.).

    Výnimky zo zásady nemo plus iuris so zameraním sa na nadobudnutie nehnuteľnosti od nevlastníka v slovenskom právnom poriadku

    The article analyzes the issue of possibility to acquire real estate from third persons who are not owners of real estate and do not also have the right to transfer the real estate. The contribution pays attention to the exceptions from the general principle of civil law nemo plus iuris ad alium transferre potest quam ispe habet. The contribution analyzes especially the acquiring of real estate from non-owner in inheritance proceedings, bankruptcy proceedings, enforcement proceedings, voluntary auction and acquiring the real estate which is not registered in the land register.
