Pozycja Czy prawo może być rozmową ?(Wydział Prawa i Administracji Uniwersytetu Rzeszowskiego, 2016-06) Licak, TomaszMożna przyjąć, że prawo we współczesnym społeczeństwie jest podstawowym medium integracji społecznej. W konsekwencji tego faktu, siła prawa wynika z posłuszeństwa obywateli. Ponieważ we współczesnym społeczeństwie władza nie jest w stanie uzyskać legitymacji sama w sobie, prawo wywodzi swoje uzasadnienie z umowy społecznej osób poddanych władzy. Nowoczesne społeczeństwo zasługuje na rekonstrukcję relacji między filozofią prawa a teorią polityczną. Wszelkie prawa powinny mieć swoja legitymację społeczną. Prawa człowieka są wywodzone z intersubiektywnych relacji między obywatelami, którzy przyznają prawa innym na zasadzie umowy społecznej. Prawo nie może być oddzielone od społeczeństwa ponieważ jest ono oparte na kompromisach i wielostronnych umowach. Dlatego też bardzo ważne są kompetencje komunikacyjne prawników a nie jedynie umiejętności prowadzenia rozmowy, gdyż komunikacja oznacza coś znacznie bardziej szerszego niż rozmowa wokalna.
