| dc.description.abstract | Niniejszy artykuł zawiera szeroką analizę członkostwa Rosji w systemie EKPC. Postawiona w nim teza badawcza zakłada uznanie, że FR przystąpiła do RE i ratyfikowała EKPC głównie z powodów politycznych, a jej władze nie zamierzały w praktyce przestrzegać jej unormowań. Zasadniczą przyjętą w tym artykule metodą badawczą jest metoda instytucjonalno-prawna, a podstawową techniką badawczą jest szczegółowa analiza – case study, a także wyciąganie wniosków na podstawie badań literatury naukowej związanych z przedmiotowym zagadnieniem. Dla oceny słuszności postawionej tezy autor dokonał analizy zjawisk, które wpływają na ocenę Rosji jako strony Konwencji, będących jednocześnie pytaniami badawczymi, takich jak: dane statystyczne dotyczące orzecznictwa strasburskiego związanego z FR na tle innych państw RE, jego wpływu na reformy systemu prawa w Rosji, reakcji ETPC na liczne wojny prowadzone przez ten kraj, czy wreszcie działań opóźniających zmiany systemu EKPC oraz systemowego problemu niewykonywania orzeczeń Trybunału przez władze rosyjskie. | dc.description.abstract | This article provides a broad analysis of Russia's membership in the ECHR system. The research hypothesis put forward in it assumes that the Russian Federation joined the CoE and ratified the ECHR mainly for political reasons, and that its authorities did not intend to comply with its provisions in practice. The basic research method adopted in the discussed article is the institutional and legal method, and the basic research technique is a detailed analysis – case study, as well as drawing conclusions based on research in the scientific literature related to the subject matter. In order to assess the validity of the thesis put forward, the author analyzed the phenomena that affect the assessment of Russia as a party to the Convention, such as: statistical data on the Strasbourg jurisprudence related to the Russian Federation against the background of other COE countries, its impact on the reforms of the legal system in Russia, the reaction of the ECtHR to numerous wars by that country, or, finally, actions delaying changes to the ECHR system and the systemic problem of non-compliance with the Court's judgments by the Russian authorities.
