Regulacje prawne w procedurach antydopingowych w tenisie

Abstract

Artykuł omawia obowiązujące regulacje prawne w zakresie zwalczania dopingu w tenisie, wskazując na złożoność systemu opartego na aktach prawa międzynarodowego, krajowego oraz regulaminie Międzynarodowej Federacji Tenisowej. Przedstawiono rolę Światowego Kodeksu Antydopingowego, krajowej ustawy o zwalczaniu dopingu w sporcie, a także kompetencje POLADA i Trybunału Arbitrażowego ds. Sportu (CAS). Omówiono procedury odwoławcze, strukturę sankcji oraz odpowiedzialność zawodników i osób wspierających, podkreślając znaczenie proporcjonalności kar, transparentności postępowań oraz ochrony praw sportowców. W zakończeniu wskazano potrzebę dalszego rozwoju prawa antydopingowego w kontekście wyzwań nowoczesnego sportu.

The article discusses the current legal regulations concerning anti-doping measures in tennis, emphasizing the complexity of a system based on international and national law as well as the regulations of the International Tennis Federation. It presents the role of the World Anti-Doping Code, the Polish Anti-Doping Act, and the competencies of POLADA and the Court of Arbitration for Sport (CAS). The study outlines the appeal procedures, the structure of sanctions, and the liability of athletes and support personnel, highlighting the importance of proportional penalties, procedural transparency, and the protection of athletes' rights. The conclusion stresses the need for further development of anti-doping law in light of the challenges posed by modern sports.
