Ustawa scaleniowa z 1933 roku a problem ubezpieczeń brackich

Abstract

Odrodzone państwo polskie podjęło trud zbudowania nowoczesnego systemu ubezpieczeń społecznych stojącego na straży ładu społecznego i scalania państwowości. W tym miejscu należy nadmienić, że na Górnym Śląsku funkcjonował dualizm w zakresie ubezpieczeń społecznych, który wynikał z postanowień prawa międzynarodowego (traktatu wersalskiego oraz konwencji górnośląskiej) i niemieckich uregulowań w zakresie ubezpieczeń społecznych. Celem niniejszego opracowania jest zaprezentowanie specyfiki ubezpieczeniowej Górnego Śląska w kontekście prób ujednolicenia systemu ubezpieczeń społecznych. Tak sformułowany cel wymusił wykorzystanie metody analizy źródeł prawnych, metody opisu i metody badań źródłowych. Proces scalania ubezpieczeń przyczynił się do wprowadzenia w całym kraju, z wyjątkiem Górnego Śląska, powszechnego ubezpieczenia chorobowego i wypadkowego. Proces ten przyczynił się także do zafunkcjonowania obowiązkowego ubezpieczenia emerytalnego dla robotników i jednolitego ubezpieczenia na wypadek bezrobocia oraz powszechnego ubezpieczenia pracowników umysłowych.

The reborn Polish state undertook the effort of building a modern system of social insurance, guarding the social order and consolidating the statehood. At this point, it should be mentioned that in Upper Silesia, there was a dualism in the field of social insurance, which resulted from the provisions of international law (the Treaty of Versailles and the Upper Silesian Convention) and German regulations in the field of social insurance. The aim of this study is to present the specifics of the insurance of Upper Silesia in the context of attempts to unify the social insurance system. Such a goal necessitated the use of the method of reviewing the literature on the subject, the method of description, and the method of source research. The process of merging insurance contributed to the introduction of universal sickness and accident insurance throughout the country, with the exception of Upper Silesia. This process also contributed to the functioning of compulsory pension insurance for workers and uniform unemployment insurance and universal insurance for white-collar workers.
