Problematyka pojęcia pomocy państwa na gruncie przepisów Traktatu o Funkcjonowaniu Unii Europejskiej

Abstract

Autor porusza tematykę związaną z określeniem definicji pomocy publicznej na podstawie analizy przepisów Traktatu o Funkcjonowaniu Unii Europejskiej oraz wybrane stanowiska doktryny. Celem opracowania jest wskazanie optymalnego określenia treści potencjalnej definicji, z uwagi na brak konkretnego zapisu w świetle obecnych przepisów. Opracowanie zostało dokonane na podstawie analizy porównawczej odmiennych stanowisk doktryny oraz orzecznictwa w celu ustalenia kluczowych elementów omawianego zagadnienia. Wynikiem rozważań dokonanych przez autora, jest przedstawienie autorskiej, przykładowej definicji pomocy państwa.

The author discusses the subject matter related to the definition of state aid definition based on the analysis of the provisions of the Treaty on the Functioning of the European Union and selected doctrinal positions. The aim of the study is to indicate the optimal concept of the content of the potential definition, due to the lack of a specific definition in the light of the current provisions. The study was made on the basis of comparative analysis of different positions of doctrine and case law in order to determine the key elements of the discussed issue. The result of the author's deliberations is the presentation of an authoritative, exemplary definition of state aid.
