Urząd i tytuł hrabiego w świetle prac XVIII- i XIX-wiecznych prawników konstytucjonalistów i niemieckich pisarzy politycznych

Abstract

Rozwój struktur arystokratycznych na obszarach Świętego Cesarstwa Rzymskiego Narodu Niemieckiego już w okresie ich kształtowania się budził potrzebę zrozumienia genezy tego procesu i jego etapów rozwojowych. Pierwsze konstatacje poczynione zostały przez znakomitych prawników konstytucjonalistów i pisarzy politycznych, takich jak J. Lünig, J. Moser, C Pauli, J. Pütter, Ch. Scheidt, F. Lobethan, J. Loen. Opierały się na analizie materiału archiwalnego (głównie kancelaryjnego), aktualnego stanu prawnego i obserwacjach natury protosocjologicznej. Kategoryzacje te uznawały mnogość tytulatury hrabiowskiej, przy jednoczesnym zawarowaniu miejsca jej beneficjentom na szczycie hierarchii społecznej pomiędzy książętami a baronami. Hrabia mógł mieć status książęcy Rzeszy (landgrabiowie, margrabiowie), status hrabiego Rzeszy rzeczywistego (reichsunmittelbare Graf) i hrabiego Rzeszy tytularnego (Titulargraf, mediate, reichsmittelbare Graf), jak również hrabiego zwykłego o prawach lennych jednakich szlachcie ziemi (Landsassen). Status hrabiowski związany był z szerokim uprzywilejowaniem w takich dziedzinach, jak sądownictwo, wojskowość czy prawa własności. Otwierał drogę do pozyskiwania praw politycznych, prestiżowych, dawał duży zakres sformalizowanego autorytetu w życiu publicznym.

During the course of the development of aristocratic structures in the Holy Roman Empire of the German Nation, the need to understand its genesis and stages of development arose. The first observations were made by eminent lawyers, constitutionalists and political writers such as J. Lünig, J. Moser, C. Pauli, J. Pütter, Ch. Scheidt, F. Lobethan, J. Loen. They were based on the analysis of archival material (mainly the chancellery), the current legal status, and observations of a proto-sociological nature. The first categorizations recognized a multitude of count's titles, while at the same time giving its beneficiaries a place at the top of the social hierarchy between dukes and barons. A count could have the status of a prince of the Reich (Landgraves, Margraves), the status of a real Count of the Reich (Reichsunmittelbare Graf) and a titular Count of the Reich (Titulargraf, mediate, reichsmittelbare Graf), as well as an ordinary count with feudal rights equal to the nobility of the land (Landsassen). The status of a count was associated with a broad range of privileges in such areas as the judiciary, military or property rights, as well as the acquisition of broad political, prestige and rank rights to a wide range of formalized authority in public life.
