Glosa do wyroku Sądu Apelacyjnego w Katowicach z dnia 2 marca 2023 r. (II AKa 208/22)

Abstract

W opracowaniu podniesiono kwestie związane z odpowiedzialnością karną za przestępstwo prania pieniędzy (art. 299 § 1 k.k.) w oparciu o stanowisko zajęte przez Sąd Apelacyjny w Katowicach w wyroku z dnia 2 marca 2023 r. (II AKa 208/22). Przedmiotem glosy uczyniono zarówno tezę wyroku, jak i inne zagadnienia, które zostały poruszone przez ten sąd w uzasadnieniu do przedmiotowego judykatu. Wyrażono przy tym aprobatę dla zapatrywania zaprezentowanego przez Sąd Apelacyjny w Katowicach w zakresie omawianych kwestii.

The study raises issues related to criminal liability for the crime of money laundering (Article 299 § 1 of the Penal Code) based on the position taken by the Court of Appeal in Katowice in the judgment of March 2, 2023 (II AKa 208/22). The subject of the commentary is both the thesis of the judgment and other issues that were raised by this court in the justification for the judgment in question. Approval was also expressed for the view presented by the Court of Appeal in Katowice regarding the issues discussed.
