Powołanie Ministerstwa Przemysłu jako zmiana struktury wykonawczej – implikacje dla systemu działów administracji rządowej

Abstract

Celem opracowania jest analiza zasadności utworzenia Ministerstwa Przemysłu z perspektywy nauk prawnych i administracyjnych. Trzon wywodu oparty jest na metodzie dogmatycznoprawnej, polegającej na interpretacji przepisów regulujących organizację administracji rządowej, ze szczególnym uwzględnieniem resortów gospodarczych. Analiza osadzona została w szerszym kontekście instytucjonalnym, co umożliwia ocenę nie tylko legalności przyjętych rozwiązań, ale także ich funkcjonalnej spójności systemowej. Uzupełniająco zastosowano klasyczne kryteria nauki administracji – sprawność: skuteczność, efektywność i ekonomiczność – bez odwołań do metod empirycznych. W artykule postawiono pytanie, czy reaktywacja resortu przemysłu miała charakter czysto polityczny, czy była odpowiedzią na rzeczywiste deficyty organizacyjne. Ocenie poddano także tryb legislacyjny reorganizacji – w tym relację między aktem wykonawczym a systemem działów. Ostatecznie, celem opracowania jest nie tylko rekonstrukcja podstaw prawnych, ale również sformułowanie postulatów dotyczących ładu administracyjnego i ewentualnych zmian systemowych.

The aim of this paper is to assess the legitimacy of establishing the Ministry of Industry from the perspectives of legal and administrative sciences. The core analysis applies the legal-dogmatic method, interpreting regulations governing the structure and organization of government administration, particularly in relation to economic ministries. The discussion is embedded in a broader institutional context, enabling evaluation not only of legal compliance but also systemic and functional coherence. Complementarily, classical administrative science criteria—efficiency, effectiveness, economy, and performance—are applied, without recourse to empirical methods. The evaluation focuses not on the Ministry’s concrete actions, but on the systemic conditions of its creation and institutional positioning. The paper asks whether the reactivation of the Ministry was a politically symbolic move or a response to real structural deficiencies in industrial policy governance. The legislative procedure of the reorganization is also analyzed, especially the relationship between the executive act and the system of administrative sectors. Ultimately, the study aims not only to reconstruct the legal basis of the Ministry’s creation but also to formulate de lege ferenda recommendations for improving sectoral organization and administrative coherence.
