Pozycja prawna parafii jako osoby prawnej

Abstract

Niniejszy artykuł ma za zadanie przedstawić regulacje dotyczące istnienia parafii w polskim systemie prawnym w ujęciu ich osobowości prawnej. Wskazano w nim regulacje dotyczące podstaw oraz sposobu nabywania przez parafie osobowości prawnej. Zaprezentowano również konsekwencje oraz niebezpieczeństwa związane z modelem „wtórnego” względem prawa konkordatowego nadawania przez polskiego prawodawcę osobowości prawnej parafiom.This article is intended to present the regulations on the existence of parishes in the Polish legal system, in terms of their legal personality. It indicates regulations on the basis and manner of acquiring legal personality by parishes. Also presented were the consequences and dangers associated with the model “secondary” to the concordat law of granting legal personality by the Polish legislator to parishes.
