Postępowanie upadłościowe w procesach restrukturyzacji finansowej przedsiębiorstw

Abstract

W artykule scharakteryzowano istotę i cele restrukturyzacji finansowej przedsiębiorstw oraz pojęcie upadłości i bankructwa na tle kwestii wypłacalności, która w tym przypadku jest ważniejsza od osiągania rentowności. Następnie objaśniono podstawy prawne postępowania upadłościowego i naprawczego oraz rodzaje upadłości i ich przyczyny. Z kolei dokonano ilościowej analizy rentowności oraz upadłości przedsiębiorstw, a także oceny postępowań naprawczych w Polsce. Pracę zamyka charakterystyka skutków upadłości przedsiębiorstw oraz sposobów zapobiegania temu zjawisku.The article presents the significance and the objectives of financial restructuring of a firm as well as the concept of bankruptcy on the background of solvency which is, in that case, more important than profitability. Then the article explains legal basis for bankruptcy proceedings as well as the corrective measures, various types of bankruptcy and the reasons for it. Finally, the article presents quantitative analysis of profitability and bankruptcy of Polish firms, as well as the assessment of corrective measures. The article is concluded with a characteristics of the results of bankruptcy proceedings and the methods of preventing that process.
