dc.description.abstractPrzedmiotem artykułu jest zasada ne bis in idem, głównie w ujęciu historycznym i porównawczym. Przedstawiona jest zasada ne bis in idem w okresie rzymskim oraz jej kształtowanie się w późniejszych wiekach. Wyjaśnione jest znaczenie i zakres pojęciowy tej zasady zarówno w prawie kontynentalnym, jak i anglosaskim. Na gruncie prawa polskie przedstawiona jest ta zasada w k.p.k. z 1928, 1969 oraz 1997 r. Omówione są zmiany, jakim podlegała w polskich k.k. Zaprezentowany jest obecny kształt zasady ne bis in idem, który pozwala uznać ją za zasadę polskiego procesu karnego.pl_PL.UTF-8
dc.description.abstractThe subject of the article is the ne bis in idem principle, mainly in the historical and comparative perspective. The ne bis in idem principle is presented in the Roman period and its formation in later centuries. The meaning and conceptual scope of this principle is clarified, both in continental law and in Anglo-Saxon law. Under the Polish law this principle is presented in the codes of criminal proceedings of 1928, 1969 and 1997. The changes which were subject to the Polish penal codes are discussed. The present form of the ne bis in idem principle allows to treat this principle as this principle the Polish criminal process.pl_PL.UTF-8
