Procedury tworzenia prewencji prawnej poprzez instytucje compliance

Abstract

Celem artykułu jest przede wszystkim analiza prewencyjnej instytucji prawnej, jaką jest compliance. Może ona chronić każdy podmiot przed przypadkowymi nawet naruszeniami prawa przez organy wewnętrzne, ale także tworzyć zewnętrzne bariery ochronne. Jej wspólną cechą z amicus curiae jest obok oddziaływania prewencyjnego także to, iż wytwarzać może ona najbardziej kognitywną prezentację zagrożeń. W ten sposób jest to też tworzenie nowej wiedzy prawnej. W przypadku instytucji compliance autor znacznie dokładniej jednak omawia, jakie działania należy wykonać, aby praktycznie uruchomić tę powszechną już w Unii Europejską instytucję. Opisy ukierunkowane są tu również na wskazanie prawodawcom z parlamentu, jak w Polsce poprzez nowe instytucje prawne ułatwiać komercjalizację wiedzy i w większym zakresie pozyskiwać wiedzę ze środowisk naukowych.The purpose of the article is primarily to analyze the preventive legal institution of compliance. It can protect any entity from accidental violations of the law even by internal bodies, but also create external protective barriers. Its common feature with amicu curiae is, in addition to its preventive impact, that it can produce the most cognitive presentation of risks In this way it is also the creation of new legal knowledge. In the case of the institution of Compliance, however, the author discusses in much greater detail what actions need to be carried out in order to practically activate this institution, which is already common in the EU. The descriptions here are also aimed at showing the legislators of the new Parliament how to facilitate the commercialization of knowledge in Poland through new legal institutions and to attract knowledge from the scientific community to a greater extent.
