L'impact de l'impôt foncier sur l'évolution des recettes propres des gouvernements locaux dans les années 2008–2012

Abstrakt
Sans doute, chaque unité du gouvernement local, comme question de fait sur sa vocation et d'indiquer à la nomination, était équipée les attributs nécessaires pour permettre le fonctionnement. L'un d'eux-en plus de l'actif de l'unité-est un système de taxes sur l'immobilier, qui est la source des recettes budgétaires. Tant dans la législation que dans la littérature classés diversement l'impôt foncier et recettes des administrations locales (UGL). Ces divisions se pose souvent le concept de « impôt foncier », mais est différent de son champ d'application, ce qui influe sur l'évaluation du degré d'autonomie financière des collectivités locales à différents niveaux. En Pologne, le système actuel des taxes foncières est un sujet constant de la critique d'experts traitant de cette question. Souvent, se plaint à lui qui n'est pas adaptée aux systèmes en vigueur dans d'autres pays de l'Union européenne, où les systèmes sont basés sur la terre. Parmi les nombreuses allégations apportées au système actuel de taxation de l'immobilier, il apparaît, entre autres, que le système actuel n'apporte pas son produit au niveau local un budget. Comme une raison est donnée principalement le manque d'enregistrements a uniforme et fiable de terrains et de bâtiments, ainsi que des différences hautes et injustifiées d'un montant de bénéfice imposable diverses taxes visées à l'immobilier. Pour la mise en oeuvre du gouvernement administratif cadastre des biens immobiliers de la République de Pologne a la possibilité d'avant l'intégration à l'Union européenne dans le document de l'Union européenne « partenariat d'adhésion avec la Pologne ». Toutefois, jusqu'à présent, a réussi spécifier uniquement les règles régissant la conduite des dossiers fiscaux par les municipalités.
Nie ulega wątpliwości, w Polsce każda jednostka samorządu terytorialnego, w istocie o jej powołaniu i obok wskazania celu powołania, została wyposażona w niezbędne atrybuty mające umożliwić funkcjonowaniu. Jednym z nich – obok majątku jednostki – jest system podatków od nieruchomości, który jest źródłem dochodów budżetowych. Zarówno w aktach prawnych, jak i w literaturze różnie klasyfikuje się podatki od nieruchomości i dochody jednostek samorządu terytorialnego (JST). W podziałach tych często pojawia się pojęcie „podatki od nieruchomości”, jednakże różny jest jego zakres, co wpływa na ocenę stopnia samodzielności finansowej jednostek samorządu terytorialnego na poszczególnych szczeblach. W Polsce obowiązujący system podatków od nieruchomości jest stałym obiektem krytyki ze strony ekspertów zajmujących się tym zagadnieniem. Często zarzuca mu się, że nie jest dostosowany do systemów obowiązujących w innych krajach Unii Europejskiej, gdzie dominują systemy oparte o kataster. Wśród wielu zarzutów formułowanych wobec istniejącego systemu opodatkowania nieruchomości, pojawia się między innymi taki, że obowiązujący system nie przynosi zakładanych wpływów do budżetów lokalnych. Jako powód podaje się głównie brak jednolitej i wiarygodnej ewidencji zarówno gruntów, jak i budynków, a także wysokie i niczym nieuzasadnione różnice w wysokości opodatkowania poszczególnymi podatkami określonych nieruchomości? Do wprowadzenia w Polsce katastru nieruchomości Rząd RP zobowiązał się jeszcze przed przystąpieniem Polski do UE w tzw. dokumencie Unii Europejskiej „Partnerstwo dla Członkostwa z Polską”. Jednak, jak do tej pory, udało się jedynie sprecyzować zasady prowadzenia przez gminy ewidencji podatkowej nieruchomości.
No doubt, each unit of local government, as a matter of fact about her vocation and to indicate to the appointment, was equipped with the necessary attributes to enable operation. One of them – in addition to the assets of the unit – is a system of taxes on real estate, which is the source of budget revenue. Both legislation and the literature variously classifies property taxes and revenue of local government units (LGU). The concept of “property taxes” often appears in those classifications, but different in its scope, which affects the assessment of the degree of financial independence of local government units at various levels. In Poland, the existing system of property taxes is a constant subject of criticism from experts dealing with this issue. It is often accused of not being adapted to the systems in force in other European Union countries, where systems are based on land cadastre. Among the many objections made to the existing system of taxation of real estate, it appears, inter alia, that the current system does not bring expected revenue to local budgets. The lack of uniform and reliable records of both land and buildings, as well as high and unjustified differences in the tax rates of various properties are said to be the main reason for that. The government of Poland has commited to implement the cadastre tax before accession to the EU in the document of the European Union entitled Accession Partnership. So far, only the rules of creating the record of taxable properties have been specified.
