Obowiązek zachowania tajemnicy zawodowej przez lekarzy i psychologów w świetle projektowanych zmian do ustawy o prawach pacjenta i Rzeczniku Praw Pacjenta oraz niektórych innych ustaw

Abstract

Niniejsze opracowanie podejmuje temat zmian w przepisach regulujących tajemnicę zawodową lekarza i psychologa. Do dotychczasowych regulacji zezwalających na ujawnienie tajemnicy zawodowej, zostanie dodany kolejny wyjątek. Tym razem dotyczący pacjentów małoletnich, którzy ukończyli 13 lat. Zobowiązuje on lekarzy lub psychologów do ujawnienia określonych prawem informacji przedstawicielowi ustawowemu małoletniego pacjenta. Omówienie tych zmian oraz ich wpływ na relację pomiędzy pacjentem a podmiotem udzielającym świadczeń, pozwoli sprawdzić, czy szlachetne pobudki leżące u podstaw ustawy o zmianie ustawy o prawach pacjenta i Rzeczniku Praw Pacjenta oraz niektórych innych ustaw zostaną spełnione.

This study addresses changes in the regulations governing professional confidentiality for doctors and psychologists. Another exception will be added to the existing regulations permitting the disclosure of professional confidentiality. This time, it concerns minor patients over the age of 13. This exception obliges doctors and psychologists to disclose legally defined information to the minor patient’s legal representative. A discussion of these changes and their impact on the relationship between the patient and the provider of services will allow us to assess whether the noble intentions underlying the Act Amending the Act on Patients’ Rights and the Patient Ombudsman, as well as certain other acts, will be fulfilled.
