Dyskrecjonalność Prezesa Urzędu Ochrony Konkurencji i Konsumentów w aspekcie ochrony zbiorowych interesów klientów

Abstract

Pole badawcze artykułu stanowi dyskrecjonalność Prezesa UOKiK na tle ochrony zbiorowych interesów konsumentów poprzez klauzulę generalną dobrych obyczajów. Pojęcie dyskrecjonalności nie ma jednoznacznie sformułowanych granic, dlatego opiera się na ocenie zależnej od okoliczności faktycznych danego przypadku. Analiza problemu pozwala zrozumieć pozycję Prezes UOKiK w procesie stosowania prawa w sprawach praktyk naruszających zbiorowe interesy konsumentów.

The research field of the above topic is the discretion of the President of the Office of Competition and Consumer Protection against the background of the protection of the collective interests of consumers through the general clause of good manners. The notion of discretion does not have unambiguously formulated boundaries and is therefore based on an assessment depending on the factual circumstances of a given case. The analysis of the problem allows us to understand the position of the President of the Office of Competition and Consumer Protection in the process of applying the law in cases of practices infringing the collective interests of consumers.
