dc.description.abstractLa società italiana, come altre società di stampo liberale, si è trovata ad affrontare l’emergenza sanitaria causata dal virus SARS-CoV-2, che ha comportato drastiche limitazioni di alcune libertà fondamentali costituzionalmente protette, tra cui la libertà personale, la libertà di movimento, la libertà di riunione, nonché la libertà di iniziativa economica, comprimendole fino quasi ad annullarle. Per questo è sorto il problema di stabilire i confini entro i quali la limitazione, se non la privazione, di quelle libertà può dirsi compatibile con i principi superiori dell’ordinamento, previsti dalle costituzioni e dalle carte internazionali sui diritti umani. Ciò che desta perplessità dal punto di vista costituzionale non sono tanto le misure restrittive in sé, quanto le modalità con cui esse sono state adottate nell’ordinamento italiano, e che sono molto evidenti nell’esempio della libertà di iniziativa economica.pl_PL.UTF-8
dc.description.abstractItalian society, like other liberal-minded societies, has been faced with the health emergency caused by the SARS-CoV-2 virus, which has led to drastic limitations on some fundamental constitutionally protected freedoms, including personal freedom, freedom of movement, freedom of assembly, as well as freedom of economic initiative, compressing them to the point of almost nullifying them. For this reason, the problem has arisen of establishing the boundaries within which the limitation, if not the deprivation, of those freedoms can be said to be compatible with the higher principles of the legal system, provided for by the constitutions and international charters on human rights. What is perplexing from a constitutional point of view are not so much the restrictive measures in themselves, but rather the ways in which they have been adopted in the Italian legal system, and which are very evident in the example of economic freedom.pl_PL.UTF-8
dc.description.abstractSpołeczeństwo włoskie, podobnie jak inne społeczeństwa liberalne, stanęło w obliczu zagrożenia zdrowia spowodowanego wirusem SARS-CoV-2, które doprowadziło do drastycznego ograniczenia niektórych podstawowych wolności chronionych przez Konstytucję, w tym wolności osobistej, wolności przemieszczania się, wolności zgromadzeń i wolności inicjatywy gospodarczej, aż do ich prawie całkowitej eliminacji. Pojawił się w związku z tym problem ustalenia granic, w obrębie których ograniczenie, a nawet pozbawienie tych wolności może być uznane za zgodne z zasadami ustrojowymi przewidzianymi w konstytucjach czy też międzynarodowych kartach praw człowieka. Z konstytucyjnego punktu widzenia poważne wątpliwości wzbudzają nie tyle same środki ograniczające wspomniane prawa i wolności, co raczej sposoby, w jakie zostały one wprowadzone do włoskiego systemu prawnego, a które są bardzo widoczne na przykładzie ograniczeń wolności gospodarczej.pl_PL.UTF-8
