They shared in common the institution of the initiator of the referendum (the president), low turnout, and instrumental treatment of these votes. The referendum of 1996 was intended to help Lech Wałęsa in the realization of his campaign promises. In 2015 Bronisław Komorowski wanted the referendum to win him the support of the followers of Paweł Kukiz. Many mistakes have been made during both referendums; for example: poorly worded questions, omission of detailed explanation of the consequences of the referendum, a series of manipulations from the politicians, such as the submission of additional questions. The ineffective results of these votes and the negative events surrounding their campaign had their impact on the state of the Polish direct democracy as well as on its functioning in the framework of the political system of the Third Republic.Pozycja "Kodeks wyborczy" w świetle poglądów doktryny i orzecznictwa Trybunału Konstytucyjnego. Wybrane problemy(Wydawnictwo Uniwersytetu Rzeszowskiego, 2015) Eckhardt, KrzysztofThe article discusses the jurisdiction of the Constitutional Tribunal and opinions of the doctrine on the subject of the introduction of single-member electoral districts in elections to the Senate, the possibility to vote by proxy and correspondence voting, a trial to extend the voting period over two days, and the introduction of limitations concerning the resources used during an election campaign. The adoption of these solutions emerged to meet the expectations of the doctrine, and fulfilled postulates of representatives of the electoral apparatus, in an essential way altering the electoral law, but simultaneously it aroused significant controversies. The Constitutional Tribunal was faced with a difficult task to evaluate them from the point of view of compatibility with the Constitution. Its adjudication was in advance doomed to criticism, because the Tribunal could only assume the point of view of a part of the doctrine’s representatives. The analysis carried out in this article enables the constitutional regulations concerning elections to be viewed in a new way.Pozycja Problematyka lokali wyborczych dostosowanych do potrzeb wyborców niepełnosprawnych w wyborach samorządowych 2014 roku w świetle działań Rzecznika Praw Obywatelskich(Wydawnictwo Uniwersytetu Rzeszowskiego, 2015) Zbieranek, JarosławDespite the introduction of alternative voting procedures in the Polish electoral system, a significant part of disabled or elderly voters declare that they are willing to vote in a traditional way — at the polling station. The survey carried out in March 2014 shows that over 80% of respondents indicated voting at polling stations as the preferred way of voting in an election. A very important issue is the appropriate adaptation of polling stations to the needs of voters with limited mobility. The Electoral Code significantly increases the number of polling stations adapted to the needs of people with disabilities. The head of the commune shall adapt at least 1∕5 of stations by 31 December 2014. However, as indicated by the results of the inspections carried out by the Ombudsman (Human Rights Defender) in November 2014, the vast majority of polling stations designated by the commune as adapted to the needs of people with disabilities were in fact not accessible for this group of voters. At 179 polling stations inspected by employees of the Office of the Ombudsman shortcomings were noted in 151, which accounted for 84% of all buildings visited. It is therefore necessary to take extensive measures for the real fulfilment of the requirements specified by law. A significant proportion of the voters surveyed expressed the view that of all the possible facilities, free transport of voters to the polling station would be the most useful in the next election.Pozycja Wprowadzenie e-Votingu a zmiana zachowań politycznych na przykładzie przedstawicieli „piątej Szwajcarii”(Wydawnictwo Uniwersytetu Rzeszowskiego, 2015) Pazik, AnetaThe article provides an insight into the realignment of voting behaviour of Swiss living abroad after the implementation of e-Voting. The canton of Geneva was selected as a case study in the article as it was one of the first to introduce online voting in Switzerland. In 2003 canton of Geneva together with cantons of Zurich and Neuchâtel participated in a pilot programme, the aim of which was to test e-Voting systems. A year later residents of Geneva were allowed to use online voting system in elections at cantonal and federal level. Subsequently the right was extended to other communities and in 2009 it was conferred on Swiss living abroad. The aim of the paper is to verify whether the implementation of e-Voting positively affected the turnout of citizens under consideration and if it replaced other means of voting. In the research mainly quantitative research methods were used. A statistical analysis was based on data related to voting behaviours of Swiss in period 1999–2014.
