dc.description.abstractTematem niniejszego opracowania jest analiza problematyki związanej z utrwalaniem prze-biegu posiedzeń jawnych w postępowaniu cywilnym. Choć stanowi ona zagadnienie o charakterze technicznym, w istocie odgrywa doniosłą rolę, szczególnie z uwagi na umożliwienie wydania prawidłowego rozstrzygnięcia, jak również ze względu na zapewnienie przeprowadzenia ewentu-alnej oceny postępowania, jak i samego rozstrzygnięcia, zwłaszcza w ramach postępowania od-woławczego. Problematyka utrwalenia przebiegu posiedzenia jawnego w postępowaniu cywilnym omówiona została w artykule w świetle zasadniczych zmian legislacyjnych, wprowadzonych na mocy ustawy z dnia 29 kwietnia 2010 r. o zmianie ustawy – Kodeks postępowania cywilnego. Na skutek wprowadzonych zmian zasadą utrwalania przebiegu posiedzenia jawnego w postępowaniu cywilnym stało się sporządzanie protokołu za pomocą urządzenia rejestrującego dźwięk albo obraz i dźwięk, natomiast dotychczasowy protokół pisemny nabrał charakteru wyjątkowego, suplementarnego względem jego elektronicznego odpowiednika. The following paper includes an analysis of the issues related to recording the course of pub-lic court sessions in civil proceedings. Although the analyzed issue is a matter of a technical na-ture, in fact it plays an important role, particularly in the light of allowing to pass correct decisions, as well as for ensuring the conduct of potential assessment of the proceedings and its outcome, especially in the context of an appeal. The issue of recording the course of public court sessions in the civil proceedings is discussed in the light of the essential legislative changes introduced by the Act of 29 April 2010 amending the Act – Code of Civil Procedure. As a result of the aforementioned amendments, general princi-ple governing recording of public court sessions was fundamentally altered. According to the current legal status, it includes preparation of the transcript with the use of devices that register either sound itself or sound together with image, whilst the previous written protocol became secondary, complementary with respect to its electronic equivalent.pl_PL.UTF-8
