W artykule omówione zostały postulaty zmian w zakresie prawnej ochrony informacji w polskim procesie karnym zgodnie z proponowanym brzmieniem art. 178a oraz art. 180 w projekcie ustawy o zmianie ustawy – Kodeks postępowania karnego i niektórych innych ustaw. Rozważaniaściśle proceduralne poprzedzone zostały objaśnieniem zagadnień teoretycznych związanych z przyjętym przez autorkę podziałem informacji na informacje objęte tajemnicą oraz informacje niejawne, a także z instytucją zakazów dowodowych, co było nieodzowne do prowadzenia dal-szych wywodów. Publikacja stanowi próbę oceny projektowanych zmian oraz odpowiedzi na pytanie, czy faktycznie środki zastosowane przez polskiego ustawodawcę są gwarantem właści-wych proporcji między poznaniem prawdy materialnej a ochroną dóbr, które byłyby naruszone, gdyby poznanie to nie podlegało ograniczeniom. The article refers to changes in the legal protection of information in Polish criminal law as per proposed wording of art. 178a and art. 180 contained in draft amending the law – the Code of Criminal Procedure and some other laws. Strictly procedural considerations were preceded by explanation of the theoretical issues regarding the settled by the author classification of infor-mation on strictly confidential, classified and institution of evidentary prohibition, which was essential for maintaining further arguments. This publication is an attempt to assess the proposed changes and to answer the question whether the actual measures taken by the Polish legislature guarantee the right balance between established notion of pecuniary truth and protection of proper-ty that would be infringed if such notion was not a subject to restrictions.
