Obligatory contributions made by employers to the State Fund for the Rehabilitation of Disabled People as financial and legal incentives

The paper analyzed legal regulations concerning obligatory payments made by employers to the State Fund for the Rehabilitation of Disabled Persons which serve the purposes related to the rehabilitation of disabled people. These goals are pursued in various ways. In the first place, the obligation to pay is to motivate employers to employ as many disabled people as possible. The implementation of the goals related to the rehabilitation of disabled persons is also to be achieved by introducing the obligation to make payments in a situation where the employer commits behavior that is negatively assessed from the point of view of the statute. In connection with the obligatory contributions, there is a doubt about their legal nature, including the legitimacy of treating them as an element of the financial and legal incentives system. The authors stated that by introducing new legislative solutions in the field of supporting the employment of disabled people, the legislator does not maintain the coherence of legal solutions.

The objective of present article is a reflection over chosen social initiatives realised on behalf of handicapped people on territory of podkarpackie voivodeship. Handicapped people make up a very diversified social group. It is not homogenous group, that is why a wide range of problems associated with it exists. Diversity concerns causes, kinds and degrees of handicap as well as acquired education and experience. They can be people in different age, who have secured care of a family, people who take advantage of complete care of the social institutions (secular or ecclesiastical) as well as homeless people. Gaining of satisfactory level of self-dependence, when one is a handicapped person, requires to take advantage of specialist help in order to overcome a whole series of difficulties or problems associated with the fact itself or with specifity of a certain kind of handicap.
Opieka wychowawcza nad dziećmi upośledzonymi umysłowo do 1989 roku

The purpose of the present article is to present an issue of development of educational care over mentally handicapped children till the year 1989. For education since a very long time occupied one of the main positions among social tasks, but initially it referred only to the individuals who didn’t vary from standard. Educational care over mentally handicapped children goes back to not so distant times. Importance of educational and rehabilitation work with these people increased and unquestionable dynamism of mental handicap gives hopes of achievements in this field. The reason of this situation is a development of an idea of humanitarianism, social readiness to help people who are weaker and less proficient. Furthermore, a scientific progress is essential as well as social and economic considerations. Subjective treatment of a human being’s development, positive thinking concerning chances of development of an individual as well as focus on possibilities of realisation by each person is an appeal, law and a duty that is noticed in individual and social aspect.
Polityka kadrowa wobec osób niepełnosprawnych na podstawie badań wybranych pracodawców i pracowników

The aim of the article is to identify the reasons for low employment rates of people with disabilities in Poland, and to examine whether employers, disabled employees and other staff want to talk about the rational use of the rights of a disabled employee and what views, opinions or other circumstances can make it difficult. Four hypotheses were formulated in the work, which were verified on the basis of surveys and interviews conducted in the period from March to September 2017 in the Voivodship of Silesia. The considerations were rounded off with conclusions and comments.
Powstanie i działalność Fundacji Świętego Józefa Konferencji Episkopatu Polski – odpowiedź Kościoła katolickiego w Polsce na zjawisko wykorzystania seksualnego małoletnich

Opracowane studium zaprezentowało powstanie i działalność Fundacji Świętego Józefa Konferencji Episkopatu Polski. Inicjatywa podjęta przez Polskich biskupów miała na celu nieść pomoc ofiarom wykorzystania seksualnego przez osoby duchowne posługujące w Kościele katolickim w Polsce. Stworzono narracje, z której wyłania się obraz, dzięki któremu czytelnik będzie mógł zapoznać się z przyczynami i procesem powstania Fundacji oraz z różnymi obszarami jej działalności. W tym celu posłużono się źródłami, do których należy zaliczyć: akt notarialny, statut oraz regulamin, raporty i sprawozdania Fundacji, a także aplikację Facebook, literaturą polską i zagraniczną z zakresu nauk prawnych i kanonistyki. Całościowy obraz został stworzony dzięki zastosowaniu różnych metod badawczych m.in. dogmatyczno-prawnej, historyczno-prawnej, filologicznej. Stworzone studium w małym stopniu uzupełniło lukę badawczą w tym obszarze. Powyższy artykuł pełni różne funkcje: apologetyczną, prewencyjno- pedagogiczną, edukacyjną i informacyjną. Zaprezentowane badania mogą stanowić inspirację dla innych m.in. potencjalnych fundatorów, członków i pracowników Fundacji oraz badaczy, których zainteresowała przedstawiona tematyka.
Problem pracy osób niepełnosprawnych

Handicapped people are one of the most marginalized groups in a society and come across serious barriers in an access to each domain of a social life. The barriers are both functional limitations as well as environmental barriers, which make the greatest obstacle in a social participation. A new approach to this group of people appeared, they were started to be treated as unused potential. It is associated with the fact that budgets of the countries are burdened with services for the handicapped people, on the other hand it grows from a movement on behalf of the human rights and from defining a handicap as a category of the human rights. In the article there was undertaken an attempt to answer the question: „Are the handicapped people recipients of the social aid and burden for a society or will they become rightful, active citizens?”. An answer to this question is a key issue and requires reflection. For acceptance of a certain point of view results with the specific proposals of solutions. Work makes a basic level of social integration. People deprived of work compose a main group threatened with a social exclusion. Considerations conducted in the article allow to create a statement that the main goal of the social and economic policy of the Union and its members is a promotion of employment. In the first period of membership situation of the handicapped people in Poland can even get worse. A fundamental task, it seems, should be proper implementation of the union standards in our country. Cooperation of all levels of administration and undertaking of social initiatives as well as activity of the handicapped people themselves are essential. From this in a great measure depends whether a chance will turn into reality and generally positive balance of our membership will result in a higher standard of living and perspectives of development.
Problemy społeczne – wyznacznikiem kierunków rozwoju innowacji społecznych w Polsce

Innowacje społeczne rozumiane jako projektowanie i wdrażanie nowych, kreatywnych sposobów zaspokajania potrzeb społecznych nabierają coraz większego znaczenia, wiążą się bowiem zarówno z dążeniem do racjonalizacji wydatków socjalnych państwa, jak i z chęcią ciągłego podnoszenia jakości życia jego mieszkańców. Wyróżnikiem innowacji społecznych jest szeroki zakres, który tak samo jak proces gospodarowania obejmuje wszystkie sfery aktywności przedsiębiorstw i społeczeństwa: sferę produkcji, wymiany i konsumpcji. Głównym celem artykułu jest przedstawienie znaczenia koncepcji innowacji społecznych w rozważaniach dotyczących nowych sposobów rozwiązywania problemów społecznych, w szczególności dotykających osoby starsze i niepełnosprawne. Innowacje nakierowane na zapobieganie procesom prowadzącym do wykluczenie społecznego osób starszych i niepełnosprawnych, czy też podnoszące jakość ich życia mogą okazać się nie tylko skuteczne, ale również efektywne m.in. dzięki ograniczeniu wydatków poprzez właściwe kierowanie innowacji społecznych i ich indywidualizację oraz wykorzystaniu efektów synergii. W artykule za istotne uznano związek innowacji społecznych z szeroko rozumianymi problemami społecznymi. W pierwszej części artykułu zaprezentowano definicje innowacji społecznych oraz proces ich tworzenia i wdrażania. W kolejnej części artykułu omówiono przemiany demograficzne i ich terytorialne zróżnicowanie oraz przedstawiono problem niepełnosprawności w Polsce. W ostatniej części artykułu określono rolę innowacji społecznych w procesie rozwiązywania problemów społecznych.
